Drawing upon an exemplary case surrounding a patent on the anti-cancer drug Gleevec, I trace how intellectual property regimes drive the re-institutionalization of pharmaceutical development in India today in unsettled and contested ways. I am interested in how this case resolves, in an apparent purification, into technical and constitutional components; how the technical components are entirely unsettled; and how the constitutional components open up questions regarding the relationship between biocapital and issues of constitutionalism, rights, and corporate social responsibility.

Within anthropology, as elsewhere in the human sciences, there is a tendency to divide knowledge making into two separate poles: conceptual (theory) vs. empirical (ethnography). In Theory Can Be More than It Used to Be, Dominic Boyer, James D. Faubion, and George E. Marcus argue that we need to take a step back from the assumption that we know what theory is to investigate how theory—a matter of concepts, of analytic practice, of medium of value, of professional ideology—operates in anthropology (...) and related fields today. They have assembled a distinguished group of scholars to diagnose the state of the theory-ethnography divide in anthropology today and to explore alternative modes of analytical and pedagogical practice. Continuing the methodological insights provided in Fieldwork Is Not What It Used to Be, the contributors to this volume find that now is an optimal time to reflect on the status of theory in relation to ethnographic research in anthropology and kindred disciplines. Together they engage with questions such as, What passes for theory in anthropology and the human sciences today and why? What is theory's relation to ethnography? How are students trained to identify and respect anthropological theorization and how do they practice theoretical work in their later career stages? What theoretical experiments, languages, and institutions are available to the human sciences? The preoccupation with the nation that marks much postcolonial writing, especially the Anglophone novel in India following the appearance of Salman Rushdie's Midnight's Children, has been widely remarked. In this essay I am interested in tracing how this interest in the nation-thematic has persisted into—or changed in the course of-the first decade of the new century in the fiction that has appeared since the 1980s, in response to both socio-political developments as well as changing literary trends.

This paper reconsiders the use of the term "victim" in feminist theory to attempt to find common ground for the intersection and interconnection of Western and indigenous feminisms. The role of the victim in the discourse of victimology, a branch of criminology, is assessed and applied to the work of Rajeswari Sunder Rajan and Lata Mani who both examine the construction of women's subjectivity in the practice of "sati" in India.

Mainstream economics was founded on many strong assumptions. Institutions and politics were treated as irrelevant, government as exogenous, social norms as epiphenomena. As an initial gambit this was fine. But as the horizons of economic inquiry have broadened, these assumptions have become hindrances rather than aids. If we want to understand why some economies succeed and some fail, why some governments are effective and others not, why some communities prosper while others stagnate, it is essential to view economics as embedded (...) in politics and society. Prelude to Political Economy is a study of this embeddedness; it argues for an 'inclusive' approach to institutions and the state.Modern economics recognizes that individuals' pursuit of their own selfish ends can result in socially suboptimal outcomes -- the Prisoner's Dilemma being the stark example. It has been suggested that what we need in such an eventuality is 'third-party' intervention, which can take the form of imposing punishment on players. Kaushik Basu objects to this method of wishing third parties out of thin air. He argues that if a third party that could impose its will on others were available, then it should have been modeled as a player to start with.The adoption of such an inclusive approach has implications for our conception of the state and the law. It means that the law cannot be construed as a factor that changes the game that citizens play. It is instead simply a set of beliefs of citizens; and, as such, it is similar to social norms. What the law does for an economy, so can social norms. The book discusses how the nature of policy advice and our conception of state power are affected by this altered view of the state and the law.As corollaries, the book addresses a variety of important social and philosophical questions, such as whether the state should guarantee freedom of speech, whether determinism is compatible with free will, and whether the free market can lead to coercion. This is not to deny that it leads a quasi-life as the domesticated ground for what has replaced it, or as a form of prestige: a signifier for "cutting-edge" discourses. But in (...) using the term here, I refer to the work that came into prominence after the Johns Hopkins conference on "The Structuralist Controversy" (1966), the modes of thought it made possible, and the antecedents for such thought going back to the late eighteenth century. Like the humanities generally, this Theory has become submerged in Cultural Studies, 1 which displaced it in the nineties as a central concern of institutes, interdisciplinary programs, and lecture series. "New" academic undertakings in the humanities are by definition those that have a cultural focus. Occasionally we come across programs in "Theory and Cultural Studies" which equate fields that could overlap dialogically but are not identical.Let us grant that practices at the ground level of teaching are more diverse because hiring has occurred over generations; or that there are no absolute epistemic shifts because of what Mary Poovey calls a process of "uneven development," in which "emergent" "rationalities" develop from "and retain a constitutive relationship to... residual domains" [Social Body 14-19]. At the level of marketing and image (and thus also the self-image of academics), Cultural Studies has become the primary focus of North American academic publishing in the humanities, 2 which thus reimagines itself in terms of the globalism of culture rather than the nationalism of "literature," even as the wider [End Page 67] technocratic apparatus thereby reduces the entire humanities to a form of "area studies." And as Heidegger presciently saw in 1938, publishing is a form of governmentality: through the "prearranged and limited publication of books," publishers "bring the world into the picture for the public and confirm it publicly" [139]. On the other side, if a space has been kept for Theory, it has migrated out of English into continental philosophy departments and book series. The result has been an esotericizing and narrowing of Theory to post-Heideggerian French philosophy: the most powerful current in American continental philosophy departments—hence the survival of Derrida but not the early Foucault, and hence the survival of a Derrida very different from the one who made an impact in the seventies. 3Why did Cultural Studies so readily replace Theory? And why focus on the loss of Theory rather than literature, which has also entered the domain of the residual? After all, Anthony Easthope, a decade ago, saw Theory as no more than the "symptom" of a crisis leading from the collapse of literature to the emergence of Cultural Studies [5]. In starting with the cathexis onto "culture" of an academic desire once mediated through "Theory," I suggest that both Theory and Cultural Studies are encyclopedic organizations of knowledge that have therefore served as meta- or flagship disciplines for the humanities. Constituted outside the regular structure of departments in programs and "centers," both have been responsible for a decentering innovation (recognizing the emergence of knowledges outside traditional boundaries) and a recentering of the humanities' "mission" by which it addresses the university at large. The encyclopedic impulse goes back a long way, whether it takes form in such gatherings as the early cabinets of curiosities, in universities as attempts to gather different disciplines into an institutional plurality, or in actual encyclopedias. Enkyklos paideia, meaning "circle of learning," is a gathering of subjects that are meant to be interrelated as knowledge by a single individual, in contrast to indexical systems (such as dictionaries), which are secondary reference tools that store information outside the mind for selective retrieval by different people. Actual encyclopedias, from Anglicus and Vincent of Beauvais to the Encyclopédie and Hegel's "philosophic encyclopedia," have thus been intimately tied up with existing or projected organizations of knowledge. Abstract The purpose of this paper is to empirically analyse the developmental stages of non-financial reporting in corporations, by interpreting the views of interviewees from major ethical corporations on the six major dimensions of non-financial reporting (identified in the literature) within each stage of the five-stage model of non-financial reporting (developed in this paper). This study is part of a series of papers on Triple Bottom Line reporting (TBL), and its relevance to corporate reporting practices. The TBL is perhaps the (...) pioneer for getting corporations thinking about non-financial reporting. While literature has been done extensively on the TBL framework, empirical data linking TBL and how it has helped, or even hindered corporations progressing through different stages in their non-financial reporting processes is missing. In order to facilitate this analysis, 40 interviews were conducted over 1 year, with 40 corporations selected from various sustainability indexes, focusing on corporations that adopt best practices in this area, and also have a TBL approach to non-financial reporting. The results of the analysis show that TBL certainly got corporations started in the journey of non-financial reporting but has not pushed them far enough to develop a more integrated approach to reporting nor clearly aligning their non-financial reporting performance with their financial performance and business strategy. This book seeks to provide an introductory outline of the history and theory of knowledge production, notwithstanding the vastness of the subject. It is a brief history of intellectual formation or history of ideas. One can see it as a textbook of historical epistemology, which in spatio-temporal terms historicises knowledge production and contextualises methodological development. It addresses the historical process of the social constitution of knowledge, that is, the social history of the making of knowledge.

Discipline based approach to knowledge and specialization goes back to the classical Graeco-Roman times. It was Isaac Newton’s Principia, which represented academic perfection of Renaissance inquiry, criticism, creativity and theorization. Principia set the epochal model of knowledge and led to the making of the Age of Enlightenment and the Age of Reason. August Comte heralded an era of Positivism in academic research and prepared the ground for the making of disciplines. As new knowledge accrued over centuries, specialization got diversified at (...) the expense of holistic understanding. Academics of disciplinary specialization sought to resolve the problem through multidisciplinary research. Inherently discipline centric, it got further distanced from social reality. Interdisciplinary approach began as a movement through convergence research aiming to restore holistic comprehension and draw knowledge closer to social reality. It is production of knowledge beyond disciplines and across their interfaces enabling research output to be regenerative, non-conventional and resolution oriented. (shrink)

BackgroundConventionally, transcranial direct current stimulation (tDCS) aims to focalize the current reaching the target region-of-interest (ROI). The focality can be quantified by the dose-target-determination-index (DTDI). Despite having a uniform tDCS setup, some individuals receive focal stimulation (high DTDI) while others show reduced focality (“non-focal”). The volume of cerebrospinal fluid (CSF), gray matter (GM), and white matter (WM) underlying each ROI govern the tDCS current distribution inside the brain, thereby regulating focality.AimTo determine the regional volume parameters that differentiate the focal and (...) non-focal groups.MethodsT1-weighted images of the brain from 300 age-sex matched adults were divided into three equal groups- (a) Young (20 ≤ × < 40 years), (b) Middle (40 ≤ × < 60 years), and (c) Older (60 ≤ × < 80 years). For each group, inter and intra-hemispheric montages with electrodes at (1) F3 and right supraorbital region (F3-RSO), and (2) CP5 and Cz (CP5-Cz) were simulated, targeting the left- Dorsolateral Prefrontal Cortex (DLPFC) and -Inferior Parietal Lobule (IPL), respectively. Both montages were simulated for two current doses (1 and 2 mA). For each individual head simulated for a tDCS configuration (montage and dose), the current density at each region-of-interest (ROI) and their DTDI were calculated. The individuals were categorized into two groups- (1) Focal (DTDI ≥ 0.75), and (2) Non-focal (DTDI < 0.75). The regional volume of CSF, GM, and WM of all the ROIs was determined. For each tDCS configuration and ROI, three 3-way analysis of variance was performed considering- (i) GM, (ii) WM, and (iii) CSF as the dependent variable (DV). The age group, sex, and focality group were the between-subject factors. For a given ROI, if any of the 3 DV’s showed a significant main effect or interaction involving the focality group, then that ROI was classified as a “focal ROI.”ResultsRegional CSF was the principal determinant of focality. For interhemispheric F3-RSO montage, interaction effect (p < 0.05) of age and focality was observed at Left Caudate Nucleus, with the focal group exhibiting higher CSF volume. The CSF volume of focal ROI correlated positively (r ∼ 0.16, p < 0.05) with the current density at the target ROI (DLPFC). For intrahemispheric CP5-Cz montage, a significant (p < 0.05) main effect was observed at the left pre- and post-central gyrus, with the focal group showing lower CSF volume. The CSF volume correlated negatively (r ∼ –0.16, p < 0.05) with current density at left IPL. The results were consistent for both current doses.ConclusionThe CSF channels the flow of tDCS current between electrodes with focal ROIs acting like reservoirs of current. The position of focal ROI in the channel determines the stimulation intensity at the target ROI. For focal stimulation in interhemispheric F3-RSO, the proximity of focal ROI reserves the current density at the target ROI (DLPFC). In contrast, for intrahemispheric montage (CP5-Cz), the far-end location of focal ROI reduces the current density at the target (IPL). (shrink)

Due to the complexity and versatility of network security alarm data, a cloud-based network security data extraction method is proposed to address the inability to effectively understand the network security situation. The information properties of the situation are generated by creating a set of spatial characteristics classification of network security knowledge, which is then used to analyze and optimize the processing of hybrid network security situation information using cloud computing technology and co-filtering technology. Knowledge and information about the security situation (...) of a hybrid network has been analyzed using cloud computing strategy. The simulation results show that a cyber security crash occurs in window 20, after which the protection index drops to window 500. The increase in the security index of 500 windows is consistent with the effectiveness of the concept of this document method, indicating that this document method can sense changes in the network security situation. Starting from the first attacked window, the defense index began to decrease. In order to simulate the added network defense, the network security events in the 295th time window were reduced in the original data, and the defense index increased significantly in the corresponding time period, which is consistent with the method perception results, which further verifies the effectiveness and reliability of this method on the network security event perception. This method provides high-precision knowledge of network security situations and improves the security and stability of cloud-based networks. (shrink)

Extensive empirical work has examined ethical perceptions of different occupational groups in marketing. Additionally, researchers have explored ethical apperceptions of industrial customers and retail consumers. Minimal effort, though, has been directed at investigating differences in ethical perceptions between buyers and sellers, notwithstanding considerable theoretical arguments for doing so. This paper reports the results of a study that focused on differences between retail customers’ and retail salespeople’s perceptions of questionable buying and selling behaviors. Findings indicate that the two groups differ in (...) some respect depending on which group is engaging in the questionable conduct. Managerial and future research implications are provided. In this article, I view the dynamic capabilities of a social venture by examining organizational spaces through the means of qualitative engagement. Through the explication of one such organizational space, the WCB Bank, dynamic capability is understood as inhering in the purpose, the constructed memory and selves of human actors in the organization, and the collective endeavours that make the organization through deliberative processes. Such a view of organizations, while transcending the nuance of resources, provides an idea of capability as (...) emerging from the varied meanings that human actors make in organizations. An understanding of these meanings leads to comprehending dynamic capabilities as epistemological elements which lead to accessing the knowledge of the organization for the moment. (shrink)

Free flow of culture is not always fair flow of culture. A recent spate of copyright suits by Hollywood against Bollywood accuses the latter of ruthlessly copying movie themes and scenes from America. But claims of cultural appropriation go far back, and travel in multiple directions. The revered American director, Steven Spielberg, has been accused of copying the idea for E.T. the Extra-Terrestrial from legendary Indian filmmaker Satyajit Ray’s 1962 script, The Alien. Disney’s The Lion King bears striking similarities to (...) Osamu Tezuka’s Japanese anime series, Kimba the White Lion. Neither Ray nor Tezuka’s studio sued the American filmmakers and this Article is by no means an attempt to revive any particular legal case. Rather, this Article considers copyright’s role in promoting free cultural exchange, albeit on fair terms in a global marketplace of ideas marked by sharp differentials in power, wealth, and knowledge. In this paper, I revisit the question of how and in what sense can individuals comprising a group be held responsible for morally reprehensible behaviour by that group. The question is tackled by posing a counterfactual: what would happen if selfish individuals became moral creatures? A game called the Samaritan’s Curse is developed, which sheds light on the dilemma of group moral responsibility, and raises new questions concerning ‘conferred morality’ and self-fulfilling morals, and also forces us to question some implicit (...) assumptions of game-theory. One of the central tenets of mainstream economics is Adam Smith's proposition that, given certain conditions, self-interested behavior by individuals leads them to the social good, almost as if orchestrated by an invisible hand. This deep insight has, over the past two centuries, been taken out of context, contorted, and used as the cornerstone of free-market orthodoxy. In Beyond the Invisible Hand, Kaushik Basu argues that mainstream economics and its conservative popularizers have misrepresented Smith's insight and hampered our understanding (...) of how economies function, why some economies fail and some succeed, and what the nature and role of state intervention might be. Comparing this view of the invisible hand with the vision described by Kafka--in which individuals pursuing their atomistic interests, devoid of moral compunction, end up creating a world that is mean and miserable--Basu argues for collective action and the need to shift our focus from the efficient society to one that is also fair. Using analytic tools from mainstream economics, the book challenges some of the precepts and propositions of mainstream economics. It maintains that, by ignoring the role of culture and custom, traditional economics promotes the view that the current system is the only viable one, thereby serving the interests of those who do well by this system. Beyond the Invisible Hand challenges readers to fundamentally rethink the assumptions underlying modern economic thought and proves that a more equitable society is both possible and sustainable, and hence worth striving for. By scrutinizing Adam Smith's theory, this impassioned critique of contemporary mainstream economics debunks traditional beliefs regarding best economic practices, self-interest, and the social good. The relationship between brain and mind has been extensively explored through the developments within neuroscience over the last decade. However, the ontological status of mind has remained fairly problematic due to the inability to explain all features of the mind through the brain. This inability has been considered largely due to partial knowledge of the brain. It is claimed that once we gain complete knowledge of the brain, all features of the mind would be explained adequately. However, a challenge to (...) such a position is downward causation: How do we explain the causal power that mental states exert over brain activities? If we agree that downward causation occurs, then to what extent could a sole explanation of brain activities account for our behaviour? (For they would in themselves be conditioned by the mental states which are left unexplained). This dissertation is an attempt to understand relation between brain and mind through the concept of emergence, placed in the context of complex systems approach. This will create a space to account for the causal power of mental states. The complex systems approach says that as the complexity of a system increases, we witness the emergence of novel qualities and after a certain threshold (of complexity), the emergence of a novel structure. When the body (and correspondingly, brain) reaches a certain level of complexity, the mind emerges. The brain is a complex system from which the mind emerges. The brain, consisting of billions of neurons interacting with each other, regulates the body placed in the environment. The interaction of neurons (local interactions involving self-organization) result in dynamical brain signatures (global synergy). Such signatures are correlative to mental states. Mind is the process of a living organism embodying an intentional stance. This object could be the subject itself or another distinct from the subject. With the emergence of mind, the causal powers of brain are conditioned by the mind. Such a conditioning is evident through the causal efficacy of mental states. While the brain is minimal condition for the mind to emerge, the mind in itself is embedded (showcased/explicated/manifested) throughout the body. The mind is a process that belongs to body-as-a-whole with the novel quality of intentionality. A preliminary to understanding this relation is its metaphysical inclination. A large portion of the history of philosophy of mind has advocated a metaphysics of entities where the mind and body have been seen as two entities with distinct essences. However, such attribution of entity-ship does not take into account the processual nature of these existents (that they are essentially dependent on their environment for their existence and sustenance). Thus, the category of processual unity has been introduced which sought to account for existent as emergent wholes that move towards a stable equilibrium through self-organization. By considering existents to be processual unities, we can account for their identity as a whole-in-itself (what has been called organizational closure) and also for their processual nature. The brain is a component of the body which is a complex system and is representative of the body’s stance in the world. The brain, consisting of billions of neurons interacting with each other, regulates the body placed in the environment. The interaction of neurons (local interactions involving self-organization) result in dynamical brain signatures (global synergy). Such signatures are correlative to mental states. These mental states in turn condition the brain patterns, that allows the embodying of mental states. Thus, the three-way process of the representation of body in the world by the brain, the emergence of mental state through dynamic brain patterns and the reciprocal causal power on the brain patterns by the mental states marks embodiment. The relation between brain, body and mind can be outlined as follows: A. There are complex interactions in the brain. These interactions are representative of the body’s stance in the world and are present in form of dynamical brain signatures. B. The dynamical brain signatures lead to emergence of mind as a process. The mental state has causal power which conditions the brain. C. The brain conditioned by causal power of the mind carries out embodiment of the mind throughout the body. In the dissertation, an exposition on relation between brain and mind through complex system approach is followed by a brief on relation between body and mind. The radical embodiment approach adopts the nonlinear dynamic systems theory to understand relation of brain, body and mind. It states a shift from mapping of cognitive states onto Neural Correlates of Consciousness to their mapping through dynamic brain signatures. Every mental state is embedded throughout the body. The dissertation explores the three features of consciousness, intentionality and qualia. These have previously formed a challenge within a dualistic framework and the dissertation intends to show a direction in which they can be accounted for, within the complex systems approach and radical embodiment viewpoint. After a certain threshold of the rate of production of cell assemblies is bypassed, we become conscious of the representation itself. This leads to emergence of phenomenal states. Qualia is the qualitative character of such states, which belong to the body-as-a-whole and for this reason, cannot be reduced to properties of any of the components from which it emerges (the dynamic brain signatures) or in which it is embodied (the body and its individual parts) alone. Intentionality is the novel property of mind of moving towards a certain set of attractors where attractors refer to the states that the system prefers (which would positively contribute to its fitness). The scope of this dissertation is to delineate the relation of brain to the mind and unravel some persistent troubles of philosophy of mind within such delineation. The types of components and their relation within the mind preceded by a thorough study of how the mind is embodied is an area yet to be extensively explored in the coming works. (shrink)

This book traces the evolution of Hindu theories of warfare in India from the dawn of civilization.

Conferees at the University of Alabama technology and ethics conference in early 1990 discussed, among other things, the fear that information sources are being compelled by new technology - rather than human dignity - to develop new services and distribution outlets. Also discussed was the disparity between the media rich and poor in terms of access to such new information technologies as fax newspapers, and the problems these new technologies pose for media practitioners trying to uphold traditional values.

The rapid advancement of algorithmic trading has demonstrated the success of AI automation, as well as gaps in our understanding of the implications of this technology proliferation. We explore ethical issues in the context of autonomous trading agents, both to address problems in this domain and as a case study for regulating autonomous agents more generally. We argue that increasingly competent trading agents will be capable of initiative at wider levels, necessitating clarification of ethical and legal boundaries, and corresponding development (...) of norms and enforcement capability. This statement seems counterintuitive for Merleau-Ponty, who has been called "the philosopher of the sensible." In this book, Kaushik investigates this question, arguing that Merleau-Ponty has raised the stakes of his ontology such that it is no longer a matter of finding a solution to the difference between "the real and the (...) fictive" but rather, of constellating and matrixing them. This ontological matrix amounts to a psychoanalysis of the philosophy of identity. Kaushik argues that philosophies of reflection, in which reflection seeks to coincide with its origins, are in fact uncritical because they miss the form of differentiation that limits them. His analyses of the matrices between space-imagination, light-dark, awake-asleep, repression-expression, etc., subvert these philosophies and reveal the symbolic form in terms of its lack of precise origin or destination. Drawing from recently published course materials of Merleau-Ponty's, and attentive to his reliance on literary phrases for phenomenological insights, Kaushik brings out the living force of Merleau-Ponty's thought and develops his radical insight of the primacy of the symbolic form, even in an ontology that claims to be about the sensible and its elements. Much of economics is built on the assumption that individuals are driven by self-interest and economic development is an outcome of the free play of such individuals. On the few occasions that the existence of altruism is recognized in economics, the tendency is to build this from the axiom of individual selfishness. The aim of this paper is to break from this tradition and to treat as a primitive that individuals are endowed with the ‘cooperative spirit’, which allows them to (...) work in their collective interest, even when that may not be in their self-interest. The paper tracks the interface between altruism and group identity. By using the basic structure of a Prisoner's Dilemma game among randomly picked individuals and building into it assumptions of general or in-group altruism, the paper demonstrates how our selfish rationality interacts with our innate sense of cooperation. The model is used to outline circumstances under which cooperation will occur and circumstances where it will break down. The paper also studies how sub-groups of a society can form cooperative blocks, whether to simply do better for themselves or exploit others. (shrink)

This book disentangles two terms that were conflated in the initial Anglo-American appropriation of French theory: deconstruction and poststructuralism. Focusing on Sartre, Derrida, Foucault, and Baudrillard (but also considering Levinas, Blanchot, de Man, and others), it traces the turn from a deconstruction inflected by phenomenology to a poststructuralism formed by the rejection of models based on consciousness in favor of ones based on language and structure. The book provides a wide-ranging and complex genealogy of French theory from the 1940s onward, (...) placing particular emphasis on the largely neglected early work of the theorists involved and on deconstruction’s continuing relevance. The author argues that deconstruction is a form of radical, antiscientific modernity: an interdisciplinary reconfiguration of philosophy as it confronted the positivism of the human sciences in the 1960s. By contrast, poststructuralism is a type of postmodern theory inflected by changes in technology and the mode of information. Inasmuch as poststructuralism is founded upon its “constitutive loss” of phenomenology (in Judith Butler’s phrase), the author is also concerned with the ways phenomenology (particularly Sartre’s forgotten but seminal Being and Nothingness) is remembered, repeated in different ways, and never quite worked through in its theoretical successors. Thus the book also exemplifies a way of reading intellectual history that is not only concerned with the transmission of concepts, but also with the processes of transference, mourning, and disavowal that inform the relationships between bodies of thought.
